3 malpractice updates in March

Here are three updates on policies or court rulings related to malpractice in March, as reported by Becker’s:

1. The Georgia Court of Appeals upheld a $40 million judgment against emergency room physician Matthew Womack, MD, marking what is believed to be the largest emergency room malpractice verdict in the state’s history

2. The Florida House of Representatives voted 104-6 to approve a bill that could lead to more medical malpractice lawsuits.

The bill specifically involves wrongful death lawsuits and non-economic damages for pain and suffering. According to the report, the bill would repeal part of a 1990 law that prevents people from seeking non-economic damages in certain circumstances. Current law states that people who are 25 or older cannot seek such damages in medical malpractice cases involving deaths of their parents. Parents also cannot seek damages in malpractice cases involving the deaths of their children who are 25 or older. 

3. A new study has found that physicians in Illinois have the highest malpractice payments in the country. Using data from the National Practitioner Data Bank, researchers from Noll-Law.com found that the average payment in Illinois is $746,186. Massachusetts was second at $690,405.
