$3.36M malpractice settlement reached over unnecessary ASC surgeries

A woman disfigured after undergoing 11 unnecessary procedures at an ASC has reached a $3.36 million malpractice settlement, according to a June 6 report from Law.com

What happened? 

  • Rana Husein sought treatment from cardiovascular surgeon David Greuner, MD, in January 2021 for long-term leg swelling. Without performing an MRI or other diagnostic tests, Dr. Greuner diagnosed her with arterio-venous malformations and scheduled her for treatment.
  • Between January and November 2021, he performed 11 embolization procedures, later deemed unnecessary, at the Roseland, N.J.-based Centers for Special Surgery of Essex County.
  • Following the final procedure in January 2022, Ms. Husein experienced severe leg pain and discoloration. Dr. Greuner attributed the symptoms to normal recovery and administered lidocaine and a nerve block.
  • Ms. Husein later sought care at Cooperman Barnabas Medical Center, where she was diagnosed with a hematoma and compartment syndrome. She underwent emergency surgery and multiple procedures to avoid amputation and was hospitalized for a month. She continues to suffer from nerve pain, requires daily medication, and faces permanent scarring and functional loss. 
  • Ms. Husein sued Dr. Greuner, the ASC, and its CEO, Adam Tonis, alleging Mr. Tonis allowed the unqualified physician to operate. The New Jersey attorney general subsequently revoked Dr. Greuner’s license.
  • Dr. Greuner settled the case out of court for $1.26 million in November 2023 (covered by Princeton Insurance). The ASC and Mr. Tonis settled for $2.1 million in March 2025 (covered by General Star Insurance).
