Privately held anesthesia services firm Somnia has been ordered by a federal judge to pay $2.4 million in a class action lawsuit following a 2022 data breach, according to an April 30 report from the Westfair Business Journal.
The breach, which occurred in summer 2022, affected more than 400,000 patients. Around 700 were affiliated with Phelps Hospital in Sleepy Hollow, N.Y.
The payment will go to claimants who can demonstrate that they suffered an out-of-pocket loss from the breach, according to U.S. District Judge Philip Halpern.
An external investigation performed by Somnia determined that compromised patient information included names, Social Security numbers, health insurance accounts, diagnoses and treatments.
According to the lawsuit, Somnia waited too long to notify relevant authorities about the breach.
