Physician charged in $35.3M fraud scheme 

A Boston-based physician has been charged and has agreed to plead guilty for her role in a $35.3 million Medicare fraud scheme involving genetic testing services she never provided, according to an April 25 news release from the Justice Department.

What happened?

  • From March 2017 to November 2020, Le Thu, MD, allegedly signed or caused others to sign and submit false documentation and orders for genetic testing, which is generally not covered by Medicare. These submissions falsely made it appear that Dr. Thu was providing legitimate medical services.
  • The orders claimed that Dr. Thu had consulted with beneficiaries, conducted examinations before ordering the tests, obtained their consent and intended to use the results to inform treatment decisions.In reality, Dr. Thu did not see, speak to or otherwise communicate with the Medicare beneficiaries involved.
  • As a result, Dr. Thu caused laboratories to submit approximately $35.3 million in claims to Medicare based on orders containing materially false information. Medicare paid about $25.3 million on these fraudulent claims.
